IBUDDY PRIVACY POLICY
IBuddy (a company under incorporation) (“iBuddy”, “Company” “we” or “us”) respects the privacy of the users of its App and/or the Service (“User” or “you”), and is committed to protect the personal information that its Users share with it. We believe that you have a right to know our practices regarding the information we may collect and use when you use the Service and/or when the App is installed on the Device.
Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use at www.ibuddy.io/terms_of_use (“TOU”), into which this Privacy Policy is incorporated thereto by reference.
1. Your Consent (PLEASE READ CAREFULLY!)
BY INSTALLING AND/OR DOWNLOADING THE APP ON YOUR CHILD'S DEVICE, OR BY ALLOWING THE APP TO OPERATE ON THE DEVICE YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY (THE “PRIVACY POLICY”), INCLUDING TO THE MONITORING, COLLECTION AND PROCESSING OF YOUR AND YOUR CHILD'S PERSONAL INFORMATION (AS DEFINED BELOW). IF YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT INSTALL, ACCESS AND/OR USE THE APP AND YOU ARE REQUESTED TO PROMPTLY UNINSTALL THE APP FROM YOUR CHILD'S MOBILE DEVICE.
2. Which information we may collect on and/or from our Users?
We collect individual identifiable information (“Personal Information”) from our Users. This information may identify an individual or may be of a private and/or sensitive nature.
· The Personal Information is collected from the details the User provides when registering to our Service and signs up to the Service, which consists of cell phone number, name of the child for which the user requests our Service, age of his/her child and my also include the User's name, e-mail address, and etc.
· In addition, Personal Information which is being gathered consists of any personal details provided consciously and voluntarily by contacting us via our e-mail address.
3. Which Information we may collect on and/or from our Users' children?
· We may collect two types of data and information from our Users' children:
a. The first type of information is non-identifiable and anonymous information (“Non-personal Information”). We are not aware of the identity of the User from whom we have collected the Non-personal Information. Non-Personal Information is any unconcealed information which does not enable identification of an individual person, and which is available to us while such person is entering and/or using the App and/or installs the App. Non-personal Information which is being gathered consists of technical information, behavioral information and aggregated information, and may contain, among other things, the activity of the User's child on the App, type of the User's child mobile device and its operating system and version, User's child 'click-stream' on the App, time spent on various screens of the App, etc.
b. The second type of information is Personal Information.
· User's child which our App in installed on his/her Device, may automatically provide his/her mobile device ID, mainly for enhancing his/her experience and for geo-location and security purposes as further detailed below.
· As we will monitor your child's Device, we may be exposed to Personal Information stored on and/or transmitted to his/hers Device. Monitored content may include, inter alia, the following:
o Sent and received text massages
o Geo-location
o Photos and videos
o Activity on social media apps/web sites
o Incoming/outgoing calls
o Cell-phone number
For avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.
We do not collect any Personal Information from you and/or from your child or related to you without your approval, which is obtained, inter alia, through your active acceptance to the Terms of Use and the Privacy Policy.
4. How Do We Collect Information on Our Users and their children?
There are three main methods we use:
a. We collect information which you provide us voluntarily. For example, we collect Personal Information when you register to our Service and when you contact us via the App.
b. We collect information that is included in the Device(s) and any communications made using the App. When the App is running, we collect and monitor all personal information described in Section 3 above from your child's Device. We make no use of yours and your child's Personal Information other than storing and/or processing it in connection with the provision of the Services and the purposes set forth below.
c. We collect information through your child's entry, connection, installation, access and/or use of the App. In other words, when the App is running we are aware of it and may gather, collect and store the information relating to such usage.
We may gather, collect and store such information either independently or through the help of our authorized third-party service providers as detailed below.
Please note that we may collect the abovementioned information, as long as the App is operated on the Device (other than if the "STOP" button was used by you as detailed below). We collect such data in this manner in order to achieve the purposes set forth in this Privacy Policy.
If you wish us to stop (permanently or temporarily) to monitor your child's Device, you may do so by pressing the "STOP" button available on the App. A confirmation massage will be sent to your mobile phone which will include a verification code that will be required to be typed on your child's Device. Once the code is verified the App will be deactivated.
5. What are the Purposes of the Collection of Information?
We collect Non-personal Information and Personal Information in order to provide the Service.
Non-personal Information is collected in order to:
· Use it for statistical and research purposes and for customization and improvement of our Service and our products.
· Provide and improve the Service for our commercial purposes.
· Improve the quality of the Service by formulating, customizing and enhancing the User's experience.
· Engage with third parties for commercial purposes.
Personal Information is collected in order to:
· Supply you with the Services, including the Outputs.
· Allow us to contact Users with proposals and tailored information regarding our products, events, offers, services, features, enhancements, special offers, upgrade opportunities, and events of interest etc. (including by way of newsletter).
· Verify the User's identity when he/she signs in to the Service, as well as verifying User's identity for the purpose of dealing with inappropriate interactions of User and/or fraudulent use of our Service.
· Determine geo-location information from which the User's child mobile Device is connected to the Internet in order to render the Services, for statistical purposes as well as in order to safeguard our Services.
· Be able to contact Users for the purpose of providing them with technical assistance and support.
6. Sharing Information with Third Parties
We will not share any Personal Information collected with any third party. Notwithstanding, iBuddymay share Personal Information in the following cases: (a) to satisfy any applicable law, regulation, legal process, subpoena or governmental request; (b) to enforce this Privacy Policy and/or the TOU, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to User's support requests; (e) to respond to claims that any content available on the Service violates the rights of third-parties; (f) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (g) to protect the rights, property, or personal safety of iBuddy, its Users, or the general public; (h) when iBuddy is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (i) to collect, store, process and/or manage your and your child's Personal Information through iBuddy 's authorized third parties service providers (including, as applicable, their affiliates as necessary to provide us with the requested services), as reasonable for business purposes, which may be located in a country that does not have the same data protection laws as your jurisdiction; (j) to store or process your and/or your child's Personal Information through iBuddy 's affiliated companies, which may be located in a country that does not have the same data protection laws as your jurisdiction. IBuddy requires its affiliated entities to agree to processing your Personal Information in compliance herewith; (k) cooperate with third parties for legitimate business purposes, including without limitation, enhancing the User's experience; and/or (l) pursuant to your explicit approval prior to the disclosure.
For avoidance of doubt, iBuddy has the unrestricted right to use Non-personal Information and/or aggregate information for any purpose and to transfer and disclose Non-personal Information and/or aggregate information to third parties at its own discretion. IBuddy is and shall be the sole owner of Non-personal Information and aggregate information derived from the use of the Device and/or use of the Services and/or the App.
7. Deletion or Modification of Personal Information
If for any reason you wish to delete your Personal Information and/or change the Personal Information provided during your registration process, you may do so by sending us an e-mail with adequate detail of your request to: info@ibuddy.io, and we will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws. Note that unless you instruct us otherwise we may retain and use your Personal Information, for as long as reasonably required for the purposes of which such Personal Information was collected, including without limitation, for future analytics and analysis, in order to comply with our legal or business requirements or obligations, to resolve disputes, to enforce our Terms, all as permitted under any applicable privacy laws.
Personal Information collected from your child's Device will be retained in our servers and/or our third party service providers' servers for a period of few days, and solely for the purpose of providing you the Outputs. Afterwards, such information will be automatically deleted.
Aggregate and/or anonymous information derived from your and/or use of the Service may remain on iBuddy's servers indefinitely.
8. Minors
THE SERVICE IS NOT MEANT TO BE USED BY MINORS. The Service is intended for Users over the age of eighteen (18). Therefore, iBuddy does not intend and does not knowingly collect Personal Information from minors under the age of eighteen (18) and does not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of eighteen (18) are not using the Service. If we learn that we collected Personal Information from minors under the age of eighteen (18) we will delete that information as quickly as possible. Please contact iBuddy at info@ibuddy.io if you have reasons to suspect that iBuddy collected Personal Information from minors under the age of eighteen (18) and we will delete that information as quickly as possible. Please note - although our App is installed on your child's Device and iBuddy monitors such Device, we do not have any direct contact with your child.
9. Security
We take reasonable measures to maintain the security and integrity of our App and/or information collected and prevent unauthorized access to it or use thereof through generally accepted industry standard technologies and internal procedures. The Personal Information is hosted on the Google cloud servers which provide advanced strict security standards (both physical and logical). Furthermore, we make use of proprietary firewall. Please note, however, that there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use of your Personal Information will never occur.
WE WILL NOT BE RESPONSIBLE OR LIABLE FOR UNAUTHORIZED ACCESS, HACKING, OR OTHER SECURITY INTRUSIONS OR THE THEFT, DELETION, CORRUPTION, DESTRUCTION, DAMAGE, OR LOSS OF ANY DATA OR INFORMATION.
10. Third Party Service Providers
In order to provide you with the Services via the App ,we may be using third party service providers who may collect, host, store and/or process the information detailed herein. IBuddy uses commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing and use of non-personal and personal information. Such software include without limitation, Google cloud Services which privacy policy can be found at https://www.google.com/policies/privacy/, MixPanel which privacy policy can be found at https://mixpanel.com/privacy/ and Crashlytics which privacy policy can be found at https://try.crashlytics.com/terms/privacy-policy.pdf. In addition, as part of our monitoring, we will have access to social media platforms which may include sensitive information. Please that we are not responsible for how these third party social networks use, store, and disclose information. IBuddy does not control such third party service providers. Please read their terms of use and privacy policies to understand their privacy practices.
We may provide access to your child's Personal Information collected from the Device to third parties we are engaged with in order to provide you the Outputs. Before granting such access, we will ensure that an agreement with such third parties is executed and we will require them to treat such Personal Information in accordance with this Privacy Policy.
11. International Data Transfer
We transfer information collected about you and/or your child, including Personal Information, to affiliated entities, or to other third party service provides (as provided herein) across borders and from your country or jurisdiction to other countries or jurisdictions around the world. Please note that we may transfer such information to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to such transfer of information.
12. Changes to the Privacy Policy
The terms of this Privacy Policy will govern the use of the Site and/or App and/or Portal and any information collected with respect thereto. IBuddy reserves the right to change this policy at any time, so please re-visit this page frequently. In case of any material change, we will make reasonable efforts to post a clear notice on the App and/or homepage of the Site and/or the Portal or we will send you an e-mail regarding such changes to the e-mail address that you may have provided us with. Such substantial changes will take effect seven (7) days after such notice was provided on our Site and/or App or sent by e-mail, whichever is the earlier. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Site and/or App and/or Portal after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes. In the event that the Terms should be amended to comply with any legal requirements, the amendments may take effect immediately, or as required by the law and without any prior notice.
